Terms and Conditions

Understand the policies for our building restoration services, including bookings, payments, cancellations, and responsibilities, to ensure a clear and smooth experience.

  • Serve Xpert LLC will perform all services exactly as detailed in the written Estimate and Scope of Work documents provided to you. These documents are hereby incorporated into this Agreement by reference and define the entirety of our agreed-upon tasks, including work areas, materials, and methods.

    • Any service not explicitly listed in these documents is not included in this Agreement.

    • Any modifications must be authorized via a written Change Order.

  • Our pricing reflects the comprehensive value of our specialized services, which includes our technical expertise, specialized equipment, project management, and the risk we assume.

    • Value-Based: Our fee is based on delivering the agreed-upon outcome as defined in the Scope of Work, not solely on the hours spent on-site.

    • Efficiency: Our efficiency and expertise, which may allow us to complete the work in less time, do not reduce the agreed-upon contract price.

  • A deposit is required to secure scheduling, reserve labor resources, and prepare materials in advance of your project. Once a project is approved, Serve Xpert LLC allocates personnel, equipment, and calendar availability specifically for your job. For this reason, all deposits are non-refundable.

    • Projects $7,000 and above: A non-refundable deposit of 30% of the total contract price is required to secure the project schedule.

    • Projects under $7,000 (scheduled >7 days out): A non-refundable deposit of 20% of the total contract price is required to reserve the appointment.

    • Note: Your appointment date is not confirmed until the required deposit has been paid.
       

    Balance Due: The remaining balance is due in full immediately upon completion of the work. Payment is required at job close-out before our team departs the property.

    Overdue Payments: Payments not made upon completion are considered overdue and will accrue interest at 1.5% per month (18% annually).

  • We offer three convenient payment options. Please review the details below regarding fees and financing.

    Option A: Cash, Check, & Transfers

    • Processing Fee: None.

    • Accepted Methods: Cash, Zelle, Wire Transfer, Certified or Business Checks, and Personal Checks (with advance approval).

    • Payable To: All checks must be made payable to Serve Xpert LLC.

    • Returned Checks: A $75 fee will be charged for any returned checks.

    Option B: Credit & Debit Cards

    • Processing Fee: 3.5% Processing Surcharge + State Tax.

    • Details: Payments made by Credit or Debit card are subject to a 3.5% processing surcharge, plus any applicable tax.

    Option C: Financing (Wisetack)

    • Processing Fee: 3.9% Financing Processing Fee + State Tax.

    • Details: If the Client elects to use third-party financing such as Wisetack, the financed amount may differ from the standard cash price. The financed total may include all applicable taxes and a 3.9% financing service fee charged for providing flexible monthly payment options.

    Estimated Terms & Rates:

    • 3 Months: 0% APR

    • 6 Months: 5.90% APR

    • 12 Months: 6.90% APR

    • 24 Months: 8.90% APR

    Disclaimer: Prequalification through Wisetack is performed using a soft credit inquiry and does not impact your credit score. If you choose to proceed with a payment plan after reviewing your options, a hard credit inquiry will then be conducted as part of the final approval process.

  • Once work has commenced, all services are considered rendered and are non-refundable. The costs associated with restoration—including labor, equipment mobilization, and consumed materials—are irreversible. Refunds are not issued based on the duration of the job or the outcome of an insurance claim, provided we have completed the work according to the agreed-upon Scope of Work and industry standards.

  • Any modifications or additions to the original Scope of Work must be documented in a formal, written Change Order. This document will detail the new work, associated costs, and any adjustments to the project timeline.

    • The Change Order must be signed by both the Client and an authorized representative of Serve Xpert LLC before any new work can begin.

    • We do not accept verbal requests for changes.

  • To ensure a safe and efficient project, the Client agrees to the following:
    Access: Provide safe, clear, and unrestricted access to all designated work areas and ensure all necessary utilities (electricity, water) are active.
    Clear Area: Remove all personal items, furniture, and valuables from the work area before our team arrives.
    Safety: Keep all pets, children, and other occupants away from the active work zone.
    Hazards: Inform us immediately of any known hazards or site-specific safety concerns.
    Duty to Mitigate: You are responsible for taking reasonable steps to prevent further or recurring damage after our service (e.g., repairing a leak, fixing a roof) and following all post-service care instructions provided by our team. Failure to do so may void warranties.

  • The Client is responsible for obtaining all necessary permits and regulatory approvals required for the work, unless Serve Xpert LLC specifically agrees in writing to manage them. Delays or costs resulting from a failure to secure necessary permits are the Client's responsibility.

  • Our services do not include the testing or abatement of regulated hazardous materials like asbestos or lead-based paint.

    • If we suspect such materials are present, work will stop immediately.

    • The Client is responsible for hiring a licensed abatement contractor to safely address these materials before our work can resume.

  • If pre-existing issues not visible during the initial inspection (e.g., extensive rot, active leaks, compromised structural integrity) are uncovered, we will immediately halt work in the affected area and inform you. A Change Order will be required to address these issues before we can proceed. Serve Xpert LLC is not responsible for delays or costs arising from such pre-existing conditions.

  • If our work is delayed due to conditions within the Client's control (e.g., lack of access, unavailable utilities), Serve Xpert LLC reserves the right to charge applicable delay fees or reschedule the project without penalty.

  • Serve Xpert LLC may use EPA-registered disinfectants, cleaning agents, sealants, deodorizers, and other specialized treatments as necessary for safe and effective remediation. We will follow all manufacturer guidelines and inform you of any required re-entry restrictions. By signing this Agreement, you authorize Serve Xpert LLC to apply such treatments and agree to follow all safety instructions.

  • Our technicians will wear appropriate PPE for their safety. Occupants and visitors are not permitted in active work zones unless explicitly authorized and equipped with the necessary PPE by Serve Xpert LLC.

  • We photograph and/or video record our projects for quality control, training, and internal records. These images may also be used for legitimate marketing purposes. If you do not wish for images of your property to be used in public marketing, you must notify us in writing before the project begins.

  • We provide a limited warranty exclusively on the services and areas where we directly performed work.

    CRITICAL CONDITION: To maintain warranty validity, you must have the underlying cause(s) of the damage permanently corrected by a qualified professional within ninety (90) days of our service completion. This includes, but is not limited to, repairing plumbing or roof leaks, addressing structural vulnerabilities, fixing HVAC malfunctions, or securing the property. Failure to provide proof of such repairs within this timeframe will render all warranties null and void.

    • Warranty Exclusions: The warranty is void if our work is altered by others, new damage occurs, or you fail to notify us in writing of a concern within 30 days of service.

    • Service Fee: A $250 service fee applies for any warranty inspection where the issue is found to be unrelated to our workmanship or outside the scope of our warranty.

    Coverage Limitation: Our warranty obligation is limited to re-servicing the affected area. We are not responsible for reimbursement, replacement of materials, or any indirect or consequential damages.

  • We require a minimum of forty-eight (48) hours' written notice to cancel or reschedule a service. If a cancellation occurs with less notice, the Client may forfeit their deposit and/or be billed for any costs already incurred.

  • The Client is fully and solely responsible for the payment of our invoices, regardless of the status or outcome of any insurance claim.

    • Our service agreement is with you, the property owner, not your insurance provider.

    • Any funds paid by an insurer for our services must be immediately used to pay our outstanding invoices.

  • Any use of Serve Xpert LLC documents (estimates, reports, photos, invoices) for fraudulent purposes, such as inflated insurance claims, is a serious breach of this Agreement and may lead to immediate termination of services, cancellation of all warranties, and legal action.

  • Payment is due in full upon completion. We reserve the legal right to file a Mechanic’s Lien against your property if full payment is not received. This is a legal claim to recover outstanding balances and is filed only after standard collection efforts fail.

  • Serve Xpert LLC is not responsible for delays caused by events beyond our reasonable control, such as natural disasters, government restrictions, or pandemics. Our obligations will be paused until the event concludes.

  • Should any dispute arise, both parties agree to first attempt resolution in good faith through direct communication. If unresolved, the dispute shall be settled through binding arbitration. By agreeing to these terms, both parties waive the right to a jury trial and to participate in a class action lawsuit.

  • If any part of this agreement is found to be invalid or unenforceable, the remaining parts shall remain in full force and effect.

  • This Agreement, along with the incorporated Estimate and Scope of Work, constitutes the entire understanding between Serve Xpert LLC and the Client. It supersedes all previous discussions or agreements.

    • Attorney’s Fees: The prevailing party in any legal action related to a breach of this agreement is entitled to recover reasonable attorney’s fees and costs.

    • Insurance Communications: You authorize Serve Xpert LLC to communicate directly with your insurance provider and share relevant documents to assist with your claim.

    • Right to Suspend Work: We may pause services if payments are delayed or if you fail to provide a safe work environment. A $500 demobilization/remobilization fee will apply if work is suspended due to your fault.

    • Ownership of Documents: All documents produced by Serve Xpert LLC remain our property until full payment is received.

    Equipment Tampering: You are responsible for any damage to or interference with our equipment on your property.

    • Pre-Existing Conditions: We are not responsible for pre-existing conditions (e.g., previous mold, fire damage, structural issues) unless damage was caused by our direct negligence.

    • Confidentiality: Our work methods and pricing structures are confidential. You agree not to share this information for competitive purposes.

    • Indemnification & Hold Harmless: The Client agrees to indemnify, defend, and hold Serve Xpert LLC harmless from any claims or liabilities arising from the client's failure to disclose pre-existing conditions, maintain necessary repairs after our service, or comply with their obligations under this agreement.

    • Governing Law: This agreement is governed by the laws of the jurisdiction where the work is performed.

    • Value-Based Pricing: You acknowledge our pricing is based on the comprehensive value delivered, not solely on time spent.

    • Insurance Funds: You agree to use any insurance funds paid for our services to pay our invoices immediately.

    • Authorized Representative: By booking our services, you confirm you are at least 18 years old and have the legal authority to enter into this contract.

    • Returned Check Fee: $75.

    • Warranty Re-Visit Fee: $250.

    • Demobilization/Remobilization Fee: $500.
